A holding period is only one part of the decision
An investment structure may be held for education, retirement or a return to Australia. Understand how it works and whether it fits the goal before focusing on the tax treatment of a later payment.
How the timing rule is commonly described
ATO material explains that, for relevant policies, the full reversionary bonus can be assessable in the first eight years, two-thirds in year nine and one-third in year ten. A qualifying bonus received after more than ten years can fall outside section 26AH.
Why the detail matters
The policy start date, type of policy, additional contributions, ownership, transfers, surrender timing and the taxpayer's residence can all matter. Other tax provisions can also apply. This is why the rule should be treated as a planning framework rather than a simple countdown.
For Australians living overseas
Internationally mobile Australians need to consider not only Australian rules but also the tax treatment in the country where they live now and where they expect to live when funds are accessed. A structure that appears efficient in one jurisdiction may be treated differently elsewhere.
- When did the policy commence?
- Have additional premiums been made?
- Where are you tax resident now?
- Where do you expect to be resident when withdrawing or surrendering?
- What are the product charges and liquidity rules?
- How is the policy treated on death or a future move?
Keep the ten-year concept in context
Section 26AH concerns certain bonuses under eligible life assurance policies. The eligible period and later premium changes matter; a sufficiently large premium increase can restart the relevant period. It is not a universal ten-year tax exemption for every investment, account or overseas structure. Residence, contract history and other provisions need separate review.
The planning question is wider than a tax label
Imagine a family abroad comparing an international investment with keeping more assets in Australia. They may return in three years, ten years or not at all. The relevant questions include access, costs, currency, ownership and treatment on return, rather than assuming one holding period settles every issue.
Keep contribution histories, policy documents, purchase records and dates of residence changes. If you are considering a structure, have its exact legal form assessed in the relevant jurisdictions. A familiar product name is not enough to establish its treatment.
Compare the arrangement, not just the label
